Reminder for Employers: Certain Employees with an SSA TNC Should Visit Local Office by December 31

USCIS has stated that it "prefers" employees issued a SSA TNC from March 2 to December 31, 2020 visit their local SSA office to begin resolving the TNC by December 31, 2022.

As Business Information Group has previously reported, the Social Security Administration (SSA) stopped all processes related to resolving E-Verify Tentative Nonconfirmations for the majority of the last two years. In July, SSA announced that they would be resuming normal TNC resolution operations on July 15, 2022. The announcement also recommended that employees wait to begin resolving their SSA TNCs depending on the date the case was referred to SSA. USCIS has stated that these timeframes are recommended, but that all employees must visit SSA to resolve their TNC by the final deadline of September 29, 2023 or their cause will automatically fall into Final Nonconfirmation Status.

If the date on the employee's Referral Date Confirmation is:

Then the employee should visit SSA between:

March 2 to December 31, 2020 October 1 to December 31, 2022
January 1 to December 31, 2021 January 1 to March 31, 2023
January 1 to July 14, 2022 April 1 to June 30, 2023

Clients should reach out and encourage employees to comply with the "preferred" dates listed above so as to allow ample time for case resolution and completion prior to the September 2023 deadline. This process - resolving the outstanding SSA TNCs - is required regardless of whether you are enrolled in BIG's automatic E-Verify service.

As always, BIG remains committed to monitoring this constantly-evolving situation and can be relied upon to keep all clients updated on current changes and trends.
